Terms and Conditions for the supply of goods through this website. This service is operated by Gift-library.com Limited (Incorporated in England and Wales, Co. No. 6651133, VAT No. 937 3016 29) whose registered office is at Unit 1b, Bannon Court, 54-58 Michael Road, London, SW6 2EF (“we”, “us” or “our”).

1. Your Order

We must receive payment in full for your order before your order will be accepted by us. Once we have accepted your order and payment has been received we will confirm our acceptance of your order by sending you an email to the email address provided in your order form [or registered to your account with us]. Our acceptance of your order creates a legally binding contract between you and us. Only adults aged 18 and over are entitled to transact through this site. Anyone aged under 18 is prohibited from ordering goods using this website. By placing an order you certify that you are aged 18 or over.

2. Prices

2.1 The prices payable for goods that you order are as set out by Gift-library at the time of your order.

2.1.1 All of our prices are GB£ - any other currency displayed on the site is for comparison only. You will be billed in GB£. If you purchase from outside the UK, currency fluctuations and credit card charges may make a difference to the amount billed to your credit/debit card.

2.2 You may be required to pay extra for delivery and it might not be possible for us to deliver to some locations. Our delivery charges are set out in our website. If we are unable to deliver to your location we will notify you of this by email and invite you to chose a different delivery location [or accept a full refund/cancel your order].

3. Cancellation by you

3.1 Subject to 3.3 below, you may cancel your order at any time up to the end of the 7th day after the date you receive the goods. You do not need to give us any reason for cancelling your order nor will you have to pay any penalty. You will have to return the goods to us in accordance with the procedure set out in this paragraph 3. You may not cancel your order if the goods ordered are made to your specifications or are clearly personalised or which by reason of their nature cannot be returned or are liable to deteriorate or expire rapidly.

3.2 To cancel your order you must notify us by email at returns@gift-library.com or telephone us on 020-7731-6645/ 0844-967-0677 or for overseas calls +44 (0)20-7731-6645.

3.3 Your right to cancel your order is subject to:

a) your not having opened the packaging.

b) your not having removed the security tag from the item.

c) you calling us within 7 days after the date of receiving the goods and receiving a ‘Returns Authorisation number’.

3.4 If you have notified us that you are cancelling your order, the sum debited from you credit card will be credited to your account as soon as possible and in any event within 5 working days of receiving the returned items PROVIDED THAT the goods in question are received by us in the condition they were in when delivered to you. If you do not return the goods delivered to you, in the way detailed below, we will be entitled to deduct the direct costs of recovering the goods from the amount to be credited to you.

4. Cancellation by us

4.1 We will not accept and reserve the right to cancel any order between you and us if:

4.1.1 we have insufficient stock to deliver the goods you have ordered;

4.1.2 we do not deliver to your area; or

4.1.3 one or more of the items you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.

4.2 If we do cancel your order we will notify you by email and will re-credit to your account any sum deducted by us from your credit/debit card as soon as possible but in any event within 5 working days of your order. We will not offer any compensation for disappointment.

5. Delivery to you

5.1 We will deliver the goods ordered by you to the address you give us for delivery when you make your order. It is your responsibility to ensure that the delivery address is correct and accurate and that there will be somebody to sign for and take delivery of the goods from the delivery service.

5.2 All UK deliveries will be made using either Royal Mail Special Delivery or Interlink.

For orders over £500 delivery is free of charge on a standard delivery.

Standard delivery (2-3 days)
£5 incl VAT

Express delivery (next working day if ordered before 3pm)
£10 incl VAT

Same day - London only (for orders placed before 4pm)
£18 incl VAT

EUROPEAN DELIVERIES
For orders over £1000 delivery is free of charge on a standard delivery. 

Standard delivery (3-4 days)
£20 incl VAT - for items of a heavier weight Gift-Library will contact you should there be an additional shipping cost.

Express delivery (1-2 days) 
£25 incl VAT - for items of a heavier weight Gift-Library will contact you should there be an additional shipping cost.

WORLDWIDE DELIVERIES
For orders over £1000 delivery is free of charge on a standard delivery. 

Standard delivery (11-15 days)
£25 incl VAT - for items of a heavier weight Gift-Library will contact you should there be an additional shipping cost.

Express delivery (7-10 days)
£40 incl VAT - for items of a heavier weight Gift-Library will contact you should there be an additional shipping cost.

5.3 If your order is returned to us because the courier or postal service could not complete delivery to you for whatever reason, you will be responsible for the additional delivery costs if the goods are re-delivered. We will contact you on the return of the goods to us by the courier or postal service and we can either arrange re-delivery of the goods or you will have the option of cancelling your order and we will reimburse your credit/debit card, less delivery fees.
UK returns:

- Call 020-7731-6645 or 0844-967-0677 or email returns@gift-library.com within 7 days after the date of receiving the goods and request a ‘Returns Authorisation number’.

- Your ‘Returns Authorisation number’ should be written on the outside of the package being returned.

- The item(s) must be packed securely in the packaging in which you’re goods were received. There is no charge for returning your goods.

- Once we have received the item(s) we will refund the full amount to your credit/debit card, however, we will not be liable to make a refund if the items are returned to us broken or damaged. Please note Delivery Charges will not be refunded.

Overseas returns:

- Call +44 (0)20-7731-6645 or email returns@gift-library.com within 7 days after the date of receiving the goods and request a ‘Returns Authorisation number’.

- You will be issued with a FedEx telephone and account number so you can arrange a collection for the return of your goods. Please ensure that you write your returns authorisation number clearly on the FedEx paperwork provided. There is no charge for returning your goods.

- Once we have received the item(s) we will refund the full amount to your credit/debit card, however, we will not be liable to make a refund if the items are returned to us broken or damaged. Please note Delivery Charges will not be refunded.

6. Liability

6.1 You will become the owner of the goods ordered when they have been dispatched to you. If the goods are not what you ordered or are damaged or defective or the delivery is of an unacceptable quantity please contact us as soon as possible.

6.2 Other than special orders, if you do not receive the goods you ordered within 2 working days within the UK or 5 working days within the EU from the date on which you placed your order, we shall hold no liability for the goods unless you notify us by email, fax or telephone of the problem within 7 of days from the date of your order. If you notify us of a problem under this paragraph, we will either:

6.2.1 to make good any shortage or non-delivery; or

6.2.2 to replace any goods that are damaged or defective; or

6.2.3 to refund to you the amount paid by you for the goods in question in whatever way we choose.

6.3 Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify us of under this paragraph and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under paragraph 6.2.3 above.

6.4 We make no representation that goods on Gift-library are appropriate or available for use in locations outside the UK. Accessing the website from territories where its contents are illegal or unlawful is prohibited. If you choose to access this site from outside the UK, you do so at your own risk and are responsible for compliance with local laws. You must comply with all applicable laws and regulations, including obtaining necessary customs, import or other permits to purchase goods from Gift-library.  We make no representation and accept no liability in respect of the export or import of the goods you purchase.

6.5 Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

7. Discount Codes and Offers

Discount codes and offers do not apply to the following items; 55 Max, Bamford watches, Bamford bags, Beasty Bags, Bellinski London, Shana London, Baby Box, Lily Stone London, Poppy and Ned, Manrico, Taschen limited edition books, Kara Ross crocodile clutch, and the following jewellery; Humphrey Butler, Josephine Daniel, Rebecca Elbek, Diane Kordas, Les Nereides, Denise Manning, Hebz by Heba Elawadi, Antea, Luis Morais diamond headed skull bracelet.

8. Notices

Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent by email to our contact address at Unit 1b, Bannon Court, 54-58 Michael Road,

London, SW6 2EF and all notices from us to you will be displayed on our website from time to time.

9. Invalidity

If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will be unaffected.

10. Privacy

You acknowledge and agree to be bound by the terms of our Privacy Policy.

11. Third Parties

11.1: Except for our affiliates, directors, employees or representatives, a person who is not a party to this agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any of these terms and conditions.

11.2We may include hyperlinks on Gift-library to websites or resources operated by third parties, including advertisers. We have not reviewed all of the sites linked to Gift-library and are not responsible for the content or accuracy of off-site pages nor are we responsible for the availability of such external websites or resources, and do not endorse and are not responsible or liable, directly or indirectly, for the privacy practices or the content of such websites, including (without limitation) any advertising, products or other materials or services on or available from such websites or resources, nor for any damage, loss or offence caused or alleged to be caused by, or in connection with, the use of or reliance on any such content, goods or services available on such websites or resources.

12. Governing Law

Your order is deemed to be completed within the UK and shall be governed by and interpreted in accordance with English Law. These terms and conditions (and any dispute, controversy, proceedings or claims of whatever nature in relation to them) shall be governed and interpreted in accordance with English Law and the English Courts shall have exclusive jurisdiction in relation thereto.

13. Entire Agreement

13.1 These terms and conditions, together with our current website prices, delivery details, contact details and privacy policy, set out the whole of our agreement relating to the supply of the goods to you by us. Nothing said by any sales person on our behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by us. Save for fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.

13.2 We make no representations or warranties about the accuracy completeness or suitability for any purpose of the information and related graphics published on our website. From time to time our site may contain technical inaccuracies or typographical errors.

14. Trade Marks

We are the operator of www.gift-library.com.  All trademarks, product names and company names or logos sited herein are the property of their respective owners. No permission is given by us in respect of the use of any such brand names, photographs, product names or titles or copyrights and such use may constitute an infringement of the owners’ rights.

15. Events beyond our control

We will not be in breach of these terms and conditions or otherwise liable for any delay in performance if the delay or failure is due to circumstances beyond our reasonable control including, without limitation, strikes, lockouts and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.
